Foodios Terms of Service

Overview
Inconceivable R and D (Pty) Ltd (henceforth, "Inconceivable") operates a decentralized social networking platform built on the Authenticated Transfer Protocol (AT Protocol), published as "Foodios" as an application, website, and associated services. These Terms of Service, combined with the Community Guidelines, Privacy Policy, and Copyright Policy, govern your use of Inconceivable's application, website, and services.
Key Note: These Terms include mandatory arbitration and class action waivers for most disputes. See Section 13 for details.
1. Eligibility and Age Verification
Users must be at least 16 years old and meet minimum age requirements under local law to enter binding agreements. Certain jurisdictions may require age verification before accessing specific features or content through methods compliant with local regulations.
2. Account Registration and Responsibilities
You must create your own account and are responsible for all activity conducted through your login credentials. Do not share your account or use another person's account.
When posting content, you warrant that you possess all necessary rights, licenses, consents, and releases for that material's use on Foodios.
Important: You alone protect your account's security. Report compromised accounts immediately to support@foodios.app. Inconceivable bears no liability for unauthorized access, theft, or fraudulent use.
If representing a company or organization, you confirm proper authority.
3. User Content
Your Responsibility: You control your content and must ensure compliance with all applicable laws and Community Guidelines. Inconceivable does not actively monitor or control user-generated content.
Inconceivable's Use: Your content may be used to operate, provide, improve Foodios, and promote its services across Foodios and the AT Protocol.
Your License Grant: By sharing content, you grant Inconceivable a limited, worldwide, non-exclusive, royalty-free license to:
- Operate and enhance Foodios and the AT Protocol
- Reproduce, modify, adapt, and publicly display your content across formats
- Enable trusted moderation partners to use your content for platform safety
- Remove, block, or modify content violating these Terms or policies
You retain ownership. Inconceivable will never sell your content without permission.
Content Deletion: Upon account deletion, Inconceivable uses reasonable efforts to remove content per applicable laws. Other AT Protocol services may retain copies outside Inconceivable's control. Complete network-wide deletion may not be possible due to the protocol's decentralized architecture.
4. Proactive Moderation and Objectionable, Abusive or Illegal Content
Inconceivable uses automated tools and human review to identify prohibited content, prioritizing terrorism materials, child sexual exploitation/abuse content, and illegal material. Detection methods include hash recognition of known illegal content and text-based violation detection. Reports from users, trusted flaggers, law enforcement, NGOs, and civil society organizations inform moderation decisions.
Foodios does not permit any content that:
- violates local or international laws or regulations
- is sexual in nature or sexually explicit or pornographic
- contains nudity
- depicts or promotes self-harm, suicide or eating disorders, or dangerous or harmful activities
- is intended to intimidate, bully or harrass individual or groups
- violates individual's privacy or shares their personal information without consent
- contains, promotes or glorifies hate speech, discrimination or prejudice towards individuals or groups
- contains or implies threats of physical harm or violence towards individuals or groups
- depicts, glorifies, promotes, or incites violence
- infringes on the intellectual property rights of others.
- is unsolicited, repetitive, or designed to manipulate or deceive users.
- is fake, fraudulent, or misleading in its representation of facts or events.
- is intentionally misleading or deceptive, fraudulent, or intended to scam users out of money or personal information.
- that impersonates an individual or entity in a deceptive or misleading manner.
Inconceivable will delete any content it deems objectionable or abusive and may additionally at its discretion suspend or delete the accounts of users posting such content or engaging in abusive or objectionable behaviour.
In addition, note that Foodios is a focused social network and content that clearly, deliberately doesn't fit into the topic area for the social network (Food) may be blocked or removed
5. Discover Feed and Recommender Systems
Inconceivable employs recommender algorithms for the Discover Feed and account suggestions. Users may opt out via settings. Third-party feeds use independent recommender systems that Inconceivable does not control.
6. Complaints and Appeals
Reporting: Use in-app tools to report rule violations. Non-users with legal standing may follow instructions at support@foodios.app.
Appeals Process: Suspended or restricted accounts may appeal using in-app tools or by emailing moderation@foodios.app within two weeks. Appeals require supporting documentation for meaningful review consideration.
7. Termination
Your Right: Delete your account anytime in settings. Personal data retention follows the Privacy Policy and serves trust/safety and legal compliance purposes. Certain Terms provisions survive termination.
Inconceivable's Right: Accounts may be suspended, restricted, or terminated without notice if you:
- Violate these Terms, Privacy Policy, Community Guidelines, or Copyright Policy
- Trigger legal requirements like court orders or regulatory demands
- Present risks to Inconceivable, Foodios, other users, or third parties involving safety, legal exposure, reputation, or platform integrity
8. Third-Party Services
Foodios may link to external websites, services, and Developer Applications on the AT Protocol. These links do not constitute endorsement or recommendation.
Inconceivable does not control, verify, or assume responsibility for third-party content, policies, or practices. You are solely responsible for reviewing third-party terms and privacy policies. Your use of external services occurs at your own risk.
9. Open Source Software
Certain Foodios components use open source licenses including MIT and Apache. Component use follows respective license terms maintained by overseeing organizations.
10. Warranty Disclaimer
Foodios and all services are provided "as is" and "as available" without warranties—express, implied, or statutory. Inconceivable disclaims all implied warranties including merchantability, fitness for particular purposes, and non-infringement.
Inconceivable makes no representations regarding third-party content, Developer Applications, or linked products/services and accepts no responsibility for them.
You may encounter inaccurate, misleading, offensive, inappropriate, untimely, or objectionable content. Inconceivable bears no liability for user-shared or third-party content.
These disclaimers apply maximally under applicable law and do not limit legally undisclaimed warranties.
11. Indemnification
You agree to indemnify, defend, and hold harmless Inconceivable, affiliates, and their officers, directors, employees, and agents from all claims, disputes, liabilities, damages, and expenses—including legal fees—arising from:
- Your access or use of Foodios
- Your content
- Your violation of these Terms or Foodios policies
- Actions through Foodios services
- Your violation of laws or third-party rights
Inconceivable may assume exclusive defense control of any indemnified matter, requiring your full cooperation.
12. Limitation of Liability
Excluded Damages: To the fullest extent permitted, Inconceivable is not liable for indirect, special, incidental, punitive, or consequential damages—including lost profits, business interruption, or data loss. Third-party claims are expressly excluded from liability regardless of cause or theory.
Exceptions: Exclusions do not apply to death or personal injury claims based on Inconceivable's fraud, criminal misconduct, gross negligence, willful misconduct, or violations of non-disclaimable statutory rights.
Monetary Cap: Except for excluded exception claims, Inconceivable's total liability is limited to one hundred U.S. dollars ($100).
These limitations apply maximally under law. If jurisdictions restrict exclusions, those restrictions apply while the remainder remains enforceable.
13. Governing Law, Jurisdiction, Venue, Dispute Resolution, and Arbitration
Governing Law: These Terms and arising disputes are governed by the law of the Republic of South Africa without regard to conflict principles.
Jurisdiction: Non-arbitrable legal actions must occur exclusively in South African courts. Both parties consent to jurisdiction and venue there and waive forum or convenience objections.
Local Law Exception: Jurisdictions requiring application of local laws for non-arbitral disputes (such as Brazil) may substitute mandatory provisions for South African governing law provisions only to the extent required.
Informal Resolution: Contact support@foodios.app to resolve disputes informally before litigation or arbitration. Allow at least 60 days for resolution attempts. Your request must include your name, email, jurisdiction, account handle, specific damages sought, supporting evidence, and notice of intent to pursue arbitration if needed.
After submitting, you agree to participate via phone or videoconference in good-faith resolution attempts. The statute of limitations and filing deadlines are tolled during this process. Informal resolution participation is a prerequisite to arbitration filing.
Mandatory Arbitration: Unresolved disputes will be resolved through final binding arbitration by AAA (U.S.) or ICDR (UK/EU) seated in your county unless parties agree otherwise. Each party selects one arbitrator; those two appoint a third.
AAA Rules are available at www.adr.org or by calling 1-800-778-7879. Submit written Demand for Arbitration to AAA with notice to Inconceivable per AAA Rules.
Filing, administration, and arbitrator fees follow AAA Rules. If Inconceivable prevails, it recovers attorney fees and costs unless the arbitrator deems claims frivolous. Prevailing users receive attorney fees and expenses per applicable law.
Safety Claims Carve-Out: Arbitration does not apply to death or personal injury claims based on Inconceivable fraud, criminal misconduct, or gross negligence. These may be brought in court or arbitration per claimant choice.
Class Action Waiver: To the extent permitted, you and Inconceivable agree that claims proceed only individually, not as class, collective, or representative proceedings.
If this waiver becomes unenforceable, the entire arbitration clause becomes void.
AAA consolidation of multiple claims under AAA Rules remains permitted.
Inconceivable Consolidation: Inconceivable may consolidate multiple arbitrations with similar issues or claimants into single consolidated arbitrations under applicable AAA rules.
Small Claims and Injunctive Relief: This arbitration clause does not restrict small claims court access or statutory rights. Public injunctive relief claims must be litigated in competent civil courts; arbitration of public injunctive relief issues is stayed pending individual claim outcomes.
Survival: This Section survives account termination.
14. Updates to Terms
Inconceivable updates these Terms periodically, posting revised versions here and notifying users through the app, website, or communications. Review regularly. Continued Foodios use after updates constitutes acceptance of revised Terms.
15. Intellectual Property
Inconceivable reserves all rights not expressly granted. The platform is protected by trademark, copyright, patent, and other U.S. and foreign laws.
Except for open source components, Inconceivable owns all applicable rights and intellectual property in the platform. Your use is subject to these Terms and does not grant rights to Inconceivable's or its partners' intellectual property unless explicitly provided.
"Intellectual Property Rights" includes all patent, copyright, mask work, moral, publicity, trademark, trade dress, service mark, goodwill, and trade secret rights under any jurisdiction's laws, including applications, registrations, renewals, and extensions.
16. General Terms
Entire Agreement: These Terms, Community Guidelines, Privacy Policy, and Copyright Policy constitute the complete exclusive agreement and supersede prior communications regarding the same subject.
If any provision is invalid or unenforceable, it will be enforced maximally under law and the remainder continues in full force.
Severability: Invalid or unenforceable provisions are severed; the remainder continues in full force.
Notices: Inconceivable may provide notices via the app, website, email, or other account-associated communication methods. Using Foodios constitutes agreement to receive electronic communications satisfying written communication requirements.
Waiver: Non-enforcement of any provision is not a rights waiver. Waivers require written signatures from authorized Inconceivable representatives. Exercising one right does not waive others unless explicitly stated.
Interpretation: These Terms are interpreted fairly without bias. "Including," "includes," "such as," and "for example" mean "without limitation."
Italicized summaries are provided for convenience only and have no legal effect. Full text governs in conflict with summaries.

18. Apple App Store and Google Play Required Terms
If accessing Foodios through an App Provider (Apple App Store or Google Play), these additional terms apply:
- These Terms are between you and Inconceivable only; the App Provider has no responsibility
- Inconceivable is solely responsible for the app and warranty compliance
- The App Provider provides no maintenance or support
- The App Provider addresses no claims related to the app
- Inconceivable handles all third-party intellectual property infringement claims
- App Providers and affiliates are third-party beneficiaries and may enforce these Terms
- You must comply with all applicable third-party service terms when using Foodios
